the short version: if it is yours and you want it gone, it is gone.

our copyright policy

This site respects the artists and rightsholders whose work it documents; it exists as commentary on and reference to that work, not as a substitute for it. Here is exactly what it holds, stated plainly rather than lawyered:

  • No audio or video. The site stores and streams no recordings of any kind, and embeds none.
  • Facts about music. Who performed what, who produced it, who sampled whom, when and on what label. Facts are not copyrightable, and documenting a sample is commentary on the recording, not a copy of it.
  • Lyric text. Song pages display lyric transcriptions drawn from public archives, presented for reference, criticism and scholarship alongside the site’s analysis of them. We believe this use is fair; if you hold rights to a composition and disagree, tell us and the text comes down — see below.
  • Images. Album covers appear as small thumbnails for identification of the records under discussion, and artist photos come from freely-licensed sources. If one is yours and you want it removed, same answer.
  • No user uploads. There are no accounts and no user-submitted content. Everything on the site was put there by the site, which means every removal request has exactly one responsible party to deal with — us — and nothing to chase across third parties.

the fast way

You do not need a lawyer to get something removed. If you hold rights to a lyric, image or anything else here and want it gone, say so through the feedback form or email decart83@gmail.com with the page address. It comes down promptly — no argument, no forms, no counter-anything. The formal process below exists for those who want the paper trail, not as a hurdle.

formal dmca notice

In accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512), we respond to clear notices of alleged copyright infringement. If you are a copyright owner, or authorized to act for one, you may deliver a notice containing:

  • Identification of the copyrighted work you claim is infringed (or a representative list, if the notice covers several).
  • Identification of the material claimed to be infringing, with enough detail to find it — at minimum the URL of the page on this site where it appears.
  • Your mailing address, telephone number, and email address.
  • This statement: “I have a good faith belief that the disputed use of the copyrighted material is not authorized by the copyright owner, its agent, or the law (for example, as a fair use).”
  • This statement: “The information in this notice is accurate and, under penalty of perjury, I am the owner, or authorized to act on behalf of the owner, of the copyright or of an exclusive right under the copyright that is allegedly infringed.”
  • Your full legal name and your physical or electronic signature.

Deliver the completed notice to the site’s designated contact:

Copyright — Graph Scene
decart83@gmail.com, subject line “DMCA notice”.

Upon receipt we will act expeditiously — in practice, faster than the statute asks. Note that under Section 512(f), a person who knowingly and materially misrepresents that material is infringing may be liable for damages; consult 17 U.S.C. § 512(c)(3) or your counsel if unsure of the requirements.

counter notices

Because nothing on this site is user-submitted, a takedown here removes material the site itself published — so in most cases there is no third party to counter-notify. If material is ever removed in response to a notice and you believe the removal was a mistake or misidentification, you may send a counter notice under Sections 512(g)(2) and (3) containing: identification of the removed material and where it appeared; a statement under penalty of perjury of your good-faith belief that it was removed by mistake or misidentification; your name, address, telephone number and email; a statement consenting to the jurisdiction of the federal district court for your district (or, if outside the United States, any district in which this site’s operator may be found) and that you will accept service of process from the party who filed the original notice; and your physical or electronic signature. Send it to the same address above with subject “DMCA counter notice”. A counter notice is shared with the original complaining party, and material may be reinstated in not less than 10 nor more than 14 business days unless the claimant files an action seeking a court order.

trademarks and other rights

Artist names, label names and record titles appear on this site to identify the music under discussion, which is the ordinary, non-infringing use of a name. If you believe a mark or some other intellectual-property right of yours is genuinely infringed here — not merely mentioned — write to the same address with: your contact details; identification of the right and evidence you hold it (registration certificate, or for unregistered rights, evidence sufficient to establish them); identification of the specific use you are challenging; a statement that the use is unauthorized and that your belief is held in good faith; and a statement under penalty of perjury that the notice is accurate and you are the owner or authorized to act for the owner. We will review it and act as appropriate, including removal, within a reasonably expeditious period — and will comply with any court order concerning material on the site.

repeat questions

Do you profit from this? No. No ads, nothing sold, no subscriptions. Will you argue fair use instead of removing my work? We believe the uses here are fair, but we will not make you litigate the point: ask, and it comes down while any discussion happens. What about the third-party archives lyrics came from? Removal here removes them here; the archives are their own operators.
